Buying  a piece of land or property in India is not a piece of cake – a lot of planning needs to be done, a lot of research and homework is involved and documentation has to be prepared, before one can finalize on the deal.

Here are some points that you should keep in mind to ensure that property that you buy is with a clear title and as they say, free of all encumbrances!

  • Check whether ownership of land is in favour of the builder – there should be an Approved License Number.
  • If applicable, check for the Urban Land Ceiling and Regulation Act Clearance certificate.
  • The original plan should be approved by Municipal authorities (total area, number of floors etc.).
  • There should be permission to use the land for Non-Agricultural purposes.
  • A Commencement certificate is usually issued by the municipal authorities, permitting the developer to start construction.
  • A title clearance certificate should be obtained from the advocate certifying that the property bears no encumbrances and it has a clear title; in short, your land should be marketable.
  • If it is a flat or apartment in question, there should be no objection from the society for the transfer and sale of the flat.
  • A share certificate from the society duly transferred in the name of the buyer should be obtained.
